Terms & Conditions of Sale

1. Company Information

AfroStocker is an online platform for the sale of digital photographic content (HD images), operated from Canada. Contact: contact@afrostocker.com

2. Acceptance of Terms

By purchasing an image on AfroStocker, you acknowledge that you have read, understood and agree to these Terms & Conditions in their entirety. These terms constitute a legally binding agreement between you (the “Customer”) and AfroStocker.

3. Products & Digital Delivery

AfroStocker sells digital image files (JPEG HD, and TIFF for Premium licences). All products are intangible digital goods. Upon successful payment:

  • A secure download link is generated immediately and sent by email.
  • The download link is valid for 72 hours and limited to 5 downloads.
  • An invoice (PDF) is automatically attached to the confirmation email.
  • The customer can access their downloads at any time from their account under My Downloads.

4. Pricing & Currency

All prices are displayed in US Dollars (USD) and are exclusive of applicable taxes. Prices in effect at the time of the order are final. AfroStocker reserves the right to modify its prices at any time, with no retroactive effect on completed orders.

  • Editorial Licence: $14.99 USD per image
  • Commercial Licence: $29.99 USD per image
  • Premium Licence: $79.99 USD per image

5. Payment

Payments are processed exclusively via PayPal. Customers may pay using a PayPal account or directly by credit card (Visa, Mastercard, American Express) through the PayPal Checkout interface. AfroStocker does not store any banking or card information. All transactions are secured and managed by PayPal (PCI-DSS Level 1 certified).

6. Licences & Intellectual Property

The purchase of an image grants a non-exclusive, non-transferable licence to use the image according to the selected tier:

  • Editorial Licence ($14.99): Press, education, NGOs, personal blogs. No commercial use permitted.
  • Commercial Licence ($29.99): Websites, apps, social media, packaging (up to 50,000 copies), advertising campaigns.
  • Premium Licence ($79.99): All commercial uses + broadcast TV, cinema, streaming, unlimited print run, merchandise resale, worldwide perpetual use.

AfroStocker retains full copyright of all images. The customer acquires a right of use only, not ownership of the image. Resale, sub-licensing or redistribution of the original file is strictly prohibited unless specified in the Premium licence.

7. Right of Withdrawal & Refund Policy

In accordance with Canadian consumer protection law and given the nature of digital goods that are made immediately available upon purchase, no right of withdrawal applies once the download link has been accessed.

However, AfroStocker commits to issuing a full refund in the following cases:

  • The file delivered is corrupted or technically defective.
  • The image delivered does not correspond to the product ordered.
  • The download link was never generated after a confirmed payment.

Refund requests must be submitted within 7 days of purchase to contact@afrostocker.com with the order number and a description of the issue.

8. Taxes

AfroStocker is based in Canada. Applicable taxes (GST/HST) may be applied to orders based on the customer’s province of residence, in compliance with the Excise Tax Act. International customers are responsible for any local taxes or duties applicable in their jurisdiction.

9. Prohibited Uses

The customer agrees not to use purchased images for:

  • Any illegal, defamatory, discriminatory or harmful purpose.
  • Adult content, pornography or exploitation.
  • Political propaganda or misleading advertising.
  • NFT creation, AI training datasets or similar derivative uses without prior written consent.
  • Any use that misrepresents the identity of the subjects depicted.

10. Limitation of Liability

AfroStocker’s liability is limited to the amount paid for the image in question. AfroStocker cannot be held liable for indirect damages, loss of revenue, or any damage arising from misuse of the licensed content.

11. Governing Law & Jurisdiction

These Terms & Conditions are governed by the laws of Canada and the applicable province. Any dispute shall be subject to the exclusive jurisdiction of the competent Canadian courts. Customers outside Canada agree that Canadian law governs their use of AfroStocker.

12. Amendments

AfroStocker reserves the right to modify these Terms & Conditions at any time. Changes take effect upon publication on this page. Continued use of the site after any modification constitutes acceptance of the updated terms.
